Raffle for a trip to banff

The “Raffle for a Trip to Banff” is organized by Couche-Tard Inc. The Contest Organizer is responsible for the Contest, its organization and the Contest Rules. The Contest will run from February 2nd, 2021 at 00:01 a.m. Eastern Standard Time (EST) until March 1th, 2021 at 11:59 p.m. (EST).

Eligibility. The Contest is open to all legal residents of Quebec who have reached the age of 18 or older at the time of entry and who have a valid passport or travel document prior to the start of the Contest Period. The name on one of the passports or travel documents must be the winner’s name. Entrant Employees, agents, representatives, officers and directors of the Contest Organizer, its subsidiaries, affiliated companies, parent corporations, advertising and promotion agencies, sponsors, suppliers of Prizes, materials and services related to this Contest, or of any other party directly associated with the holding of the Contest, as well as members of their immediate families (brothers, sisters, children, father, mother), their legal or common-law spouse, and any persons residing with these employees, agents, representatives, officers and directors are not eligible to participate.

How to participate. No purchase necessary. Complete the participation form on the website page: www.breakfastclubcanada.org/couche-tard/. Limit one (1) entry per person.

Prize. A portion of the total raffle prize is provided by Air Canada Foundation. The total value of the prize is $ 4,000 taxes included. The prize to be won includes: one (1) “Fairmont Banff Springs” getaway voucher including:

  • Two (2) nights’ accommodation for two adults in a Fairmont Gold View Room at Fairmont Banff Springs.
  • Two (2) Fairmont Gold breakfast included.
  • Two (2) domestic round-trip tickets with Air Canada to go to Calgary International Airport from a Canadian airport served by Air Canada.

Please note this package is valid from March 2nd 2021 to June 30th 2022, and is subject to hotel and airline availability. The following blackout dates will apply on Fairmont Banff Springs reservation: December 20th to December 31; special/signature events; and/or statutory/holiday periods. The following blackout dates will apply for Air Canada flights from July 24th to August 8th, 2021, from December 15, 2021 to January 5th, 2022, and from April 13th to April 20th, 2022. No changes permitted to reservations once date of travel is confirmed and tickets have been issued.

The Air Canada Foundation prize must be accepted as awarded and may be used for products and services of Air Canada or of its subsidiaries and affiliates, as applicable, in accordance with and subject to all the relevant terms and conditions applicable at the time of redemption, including Air Canada’s general conditions of carriage publicly available at www.aircanada.ca/ca/en/aco/home/legal/conditions-carriage-tariffs.html.

Prize winners are responsible for all fuel, insurance (including medical and accidental insurance), surcharges, taxes, fees and other applicable charges with a credit card at time of booking. Prize winners and their travelling companion are responsible for: any and all costs, expenses and taxes not expressly described herein including, without limitation, applicable local air departure taxes, ground transportation, including to and from the departure point, gratuities, merchandise, telephone calls, personal travel insurance (if desired), personal expenses of any nature for overnight layover, meals and beverages, service charges, in-flight meals and entertainment. Travel does not qualify for Aeroplan mileage accumulation or for mileage accumulation in any other frequent flyer program.

“Fairmont Banff Springs” getaway voucher is based on double occupancy; additional charges may apply for extra occupants. This voucher cannot be redeemed for cash and is non-transferable. Advanced reservations are required. All other expenses are the winner’s responsibility.

Raffle.  The winner will be randomly selected on March 2nd, 2021 at 10:00 a.m. ET at 135-G Mortagne Boulevard, Boucherville, QC, from all eligible entries received. The selected winner will be notified by phone and email.

Prize claim. In order to be declared a winner, the selected person must have completed the entry form on the page www.breakfastclubcanada.org/couche-tard/ during the opening period of the raffle. The winner will have until March 11, 2021 at 11:59 p.m. ET to claim their prize.

Failure to comply with one of the conditions mentioned in these rules will result in the participation of the selected person being canceled and a new draw for this prize being made in accordance with these rules until a participant is selected and declared a winner.

General conditions

Acceptance of Prize. By accepting the Prize, winner agrees to the use of his or her name, photo, and/or likeness for purposes of advertising or promotion without further compensation. Prizes must be accepted as described in these Rules and may not, in any case, be in whole or in part transferred to another person, replaced by another Prize or exchanged for cash, except as provided below.

Prize substitution. In the event where it would be impossible, difficult and/or more costly for the Contest Organizer to award a Prize (or part of Prize) as described in these Contest Rules, Contest Organizer reserves the right to award a Prize (or part of Prize) of the same kind and of equivalent value or, at the Contest Organizer’s sole discretion, the cash value of a Prize (or part of Prize) as indicated in these Contest Rules.

Limitation of liability. Use of Prize. The winner releases Contest Organizer, its subsidiaries, affiliated companies, parent corporations, advertising and promotion agencies, employees, agents, representatives, officers and directors (“Released Parties”) from any liability for damage of any kind whatsoever that he or his guests may suffer, directly or indirectly, by reason of acceptance, possession or use of the Prize, including, among other things, accidents, injuries, death, loss of enjoyment, inconveniences, disappointments, worries or frustrations or a physical or psychological nature.

For this purpose, winner hereby acknowledges and confirms that Released Parties are not granting any warranties or assurances of any kind pertaining to the Prizes awarded in connection with the Contest; acknowledges and confirms the absence of any implied warranties and (iii) agrees to sign a declaration and release form before receiving his/her Prize.

By entering the Contest, each eligible entrant acknowledges and agrees that the Contest is in no way sponsored, endorsed, administered by, nor is associated with Air Canada Foundation, its parent company Air Canada, or any of its respective subsidiaries and affiliates, and that Couche-Tard Inc. is fully responsible for the conduct and administration of the Contest, including the selection of winners and the distribution of Prizes.

Each eligible entrant further covenants and agrees to keep harmless and to release from liability Air Canada Foundation, its parent company Air Canada, and each of its respective officers, directors, employees, agents, representatives, subcontractors and affiliates with respect to any claims or actions, losses, fines or legal costs which arise, directly or indirectly in connection with the Contest and the administration thereof, the Contest Prize and any related activity.

Any and all costs incurred by a winner to claim, use or redeem his/her Prize shall be borne by the winner.

Decisions of the Contest Organizer. Any decision of the Contest Organizer regarding any aspect of this Contest, including, without being limited to, the eligibility and/or disqualification of Participation Forms, shall be final and without appeal.

Disqualification. Any person entering or attempting to enter the Contest by means that are contrary to the Rules or unfair to other Entrants (for example, entries in excess of the prescribed limit, if any) will automatically be disqualified and may be referred to the competent legal authorities.

Limitation of Liability. Content Organizer is not responsible for late, lost, incomplete, irregular or misdirected entries or for any malfunction of any computer component, software or communication line in connection with the loss or absence of network communication or with any defective, incomplete, incomprehensible or deleted transmission from any computer or network that may limit any person’s opportunity to enter the Contest or prevent him from entering the Contest. Entrants further agree to release Contest Organizer from any liability resulting from or related to participation in the Contest or the awarding or use of any Prize.

Modification. The Contest Organizer reserves the right, at its sole discretion, subject to compliance with applicable legal and regulatory requirements, to cancel, terminate, modify or suspend all or any part of this Contest at any time.

Number of Prizes Awarded. In all cases, the Contest Organizer, its subsidiaries, affiliated companies, parent corporations, advertising and promotion agencies, employees, agents, representatives, officers and directors, and their suppliers of products, materials and services related to this Contest, and their employees, agents and representatives cannot be required to award more Prizes than the number indicated in the Rules or to award prizes other than in accordance with the Rules.

If computer, printing, production, mechanical, seeding, typographical, or other errors result in more valid Prize claims for any prize level than the number stated herein, the Contest Organizer reserves the right to award the stated number of Prizes for the prize level at issue in a random draw from among all eligible, non-suspect, and valid Prize claims received for the applicable prize level.

Authorizations. By entering the Contest, Entrants agree to have their submitted name displayed on the Contest Organizer’s website, blog and Facebook page and used by Contest Organizer for any purpose regarding the Contest and for promotional and advertising purposes in connection with the Contest Organizer and its products at any time, without any fee or other form of compensation.

By entering the Contest, the winner authorizes the Contest Organizer and its representatives to use, if required, their names, photo, likeness, statements regarding the Prizes, place of residence and/or voice for advertising purposes in connection with the Contest, without any form of remuneration.

Acceptance. By participating in the Contest, Entrants agree to be bound by the Contest Rules and by the decisions of the Contest Organizer, which will be final and won’t be subject to appeal in any respect, including without limitation, any decisions concerning eligibility, disqualification of Participation Forms, or Prize attribution.

Privacy. Other than the use of the winner’s personal information as noted above, all Entrant’s personal information collected during the course of the Contest shall be used by Couche-Tard Inc., Air Canada Foundation, Air Canada and Breakfast Club of Canada solely for the purpose of conducting the Contest and awarding the Prize(s). Entrants’ personal information will be stored in the Contest database and the Contest Organizer will use it to contact Entrants for the purposes of the Contest.

Governing Law. The Contest is subject to all applicable laws in the province of Quebec and the laws of Canada applicable therein.
